1. GENERAL
YOUR USE OF THIS SITE CONSTITUTES YOUR AGREEMENT TO ABIDE BY THESE TERMS OF USE.
Golf.be bvba and its assignees, as applicable ("Golf.be"), reserve the right, in their sole discretion, to modify, alter or otherwise update these terms of use at any time and you agree to be bound by such modifications, alterations or updates. You agree to review these terms of use on a periodic basis.
You may use the materials found on Golf.be for personal, internal, non-commercial, informational purposes only. Unauthorized copying, reproduction, republishing, uploading, downloading, posting, transmitting or duplication of any of the material is prohibited.
2. COPYRIGHTS
All products and service marks contained herein that are not Golf.be marks are the trademarks of their respective owners. References that we make to any names, marks, products or services of third parties or hypertext links to third party sites or information do not necessarily constitute or imply our endorsement, sponsorship or recommendation of the third party, information, product or service.
You are not being granted a license under any copyright, trademark, patent or other intellectual property in the material or the products, services, processes or technology described therein. All such rights are retained by Golf.be and/or any third party owner rights.
Material on Golf.be may include technical inaccuracies or typographical errors. Changes may be made periodically incorporated into this material. Golf.be may make improvements and/or changes in the products, services and/or programs described in these materials at anytime without notice.
The user shall not upload, post or otherwise make available on Golf.be any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the user. The user shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of Golf.be, the user automatically grants, or warrants that the owner of such material has expressly granted Golf.be the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. The user also permits any other user to access, view, store or reproduce the material for that user's personal use. The user hereby grants Golf.be the right to edit, copy, publish and distribute any material made available on Golf.be by the user.
3. WARRANTIES
(a) The user expressly agrees that use of Golf.be is at user's sole risk. Neither Golf.be, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that Golf.be will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Golf.be, or as to the accuracy, reliability or content of any information, service, or merchandise provided through Golf.be.
(b) Golf.be is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
(c) This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. The user specifically acknowledges that Golf.be is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with the user.
(d) In no event will Golf.be, or any person or entity involved in creating, producing or distributing Golf.be or the Golf.be software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use Golf.be. The user hereby acknowledges that the provisions of this section shall apply to all content on Golf.be.
(e) In addition to the terms set forth above neither, Golf.be, nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within Golf.be, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither, Golf.be, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy or completeness of information. Additionally, there are no warranties as to the results obtained from the use of the information.
4. LINKED SITES
The linked sites are not under the control of Golf.be, and Golf.be is not necessarily affiliated with sites which may be linked to this site and is not responsible for their content. The linked sites are for your convenience only and you access them at your own risk. The inclusion of any link does not imply endorsement by Golf.be of the site.
5. Golf.be FORUMS
Golf.be is not responsible for any material posted on the forums conducted on this site. You shall not upload, transmit, distribute or otherwise publish through such forums any content which:
(a) libels, defames, or is obscene, pornographic, abusive, or threatening;
(b) infringes any intellectual property right of any entity or person, including, but not limited to violating anyone's copyrights or trademarks;
(c) violates any law;
(d) advocates illegal activity;
(e) advertises or otherwise solicits funds or is a solicitation for goods or services;
Golf.be shall have the right, but not the obligation, to monitor the content of Golf.be, including chat rooms and forums, to determine compliance with these terms of use and any operating rules established by Golf.be and to satisfy any law, regulation or authorized government request. Golf.be shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on Golf.be. Without limiting the foregoing, Golf.be shall have the right to remove any material that Golf.be, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.
You agree to indemnify Golf.be for any and all claims, damages, losses, and causes of action arising out of your publication or transmittal of non-approved material or your failure to comply with these terms of use. While Golf.be does not and cannot review every message posted by users in the forums and is not responsible for the content of these messages, Golf.be reserves the right to delete, move, or edit messages that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.
6. THIRD PARTY CONTENT
Golf.be is a distributor (and not a publisher) of content supplied by third parties and users. Accordingly, Golf.be has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers and user of Golf.be, are those of the respective author(s) or distributor(s) and not of Golf.be. 7. INDEMNIFICATION
The user agrees to defend, indemnify and hold harmless Golf.be, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of Golf.be by the user or user’s account.
8. MISCELLANEOUS
This agreement shall be governed by, construed and enforced in accordance with the laws of the state of belgium. Any action you bring to enforce this agreement or any matters related to this site shall be brought in the courts located in dendermonde. If any provision of this agreement is void or unenforceable in whole or in part, the remaining provisions of this agreement shall not be affected thereby.
